Welcome to HiveVia. These Terms of Service (“Terms”) govern your use of the HiveVia website at hivevia.com (the “Site”) and all related services provided by HiveVia (ABN 49 950 077 028) (“we,” “us,” “our”).
By accessing or using our Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site.
1. About HiveVia
HiveVia is a culturally-driven travel platform that connects travellers with destinations through cultural storytelling, character-driven content, and travel booking services. We operate from the Gold Coast, Queensland, Australia and serve a global audience.
2. Eligibility
You must be at least 18 years old to create an account, join the membership waitlist, or make bookings through our Site. Users under 18 may browse our cultural content under the supervision of a parent or guardian.
3. Accounts and Membership
3.1 Waitlist
During our initial launch phase, HiveVia membership is by waitlist only. Joining the waitlist is free and does not commit you to any payment. When paid membership opens, we will notify you with pricing and benefits before asking for payment.
3.2 Account information
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3 Accuracy
You agree to provide accurate, current, and complete information when creating an account or joining the waitlist.
4. Booking Services and Affiliate Relationships
4.1 We are an affiliate, not a travel agency
When you search for hotels, flights, car rentals, or experiences on HiveVia, the results are provided by our affiliate partners (including but not limited to Booking.com, Expedia, Skyscanner, GetYourGuide, Viator, Klook, Tiqets, and Hostelworld). When you click a booking link, you are redirected to the partner’s website to complete your booking.
4.2 HiveVia does not process bookings or payments
Your booking contract is between you and the travel provider (hotel, airline, car rental company, experience provider). HiveVia is not a party to that contract and has no liability for the booking, cancellation, refund, or quality of the service provided.
4.3 Affiliate commissions
HiveVia earns a commission from our affiliate partners when you make a booking through our links. This does not affect the price you pay. See our Affiliate Disclosure for more information.
4.4 Pricing accuracy
Prices displayed on HiveVia are provided by our affiliate partners and may change between the time they are displayed and the time you complete a booking on the partner’s website. HiveVia does not guarantee the accuracy of any price displayed.
5. Hotel Loyalty Program Information
5.1 Educational information only
Our Site displays information about hotel loyalty programs (Accor ALL, Marriott Bonvoy, Hilton Honors, IHG One Rewards, World of Hyatt) for educational purposes. This information is sourced from each hotel group’s publicly available marketing materials.
5.2 No guarantee of benefits
The benefits described on our Site are general descriptions and may vary by property, season, room type, member tier, and booking method. We do not guarantee that any specific benefit will be available for any specific booking.
5.3 Savings estimates
Where we display estimated savings ranges for hotel loyalty program members, these are approximate and based on publicly available information. Actual savings depend on many factors including property, dates, room type, member tier, and whether the booking qualifies for member rates. Bookings made through third-party sites (including our affiliate partners) may not qualify for member rates or points earning at all hotel groups.
5.4 Affiliate relationships with hotel groups
HiveVia participates in affiliate programs with selected hotel groups. Where we display hotel loyalty program information, this is sourced from each hotel group’s publicly available marketing materials unless otherwise stated. Our affiliate relationships do not constitute endorsement by, ownership by, or formal partnership with any hotel group beyond the affiliate program terms.
6. Intellectual Property
6.1 Our content
All content on HiveVia, including text, graphics, logos, character illustrations, country guides, and cultural stories, is owned by HiveVia or its licensors and is protected by copyright, trademark, and other intellectual property laws.
6.2 Character library
HiveVia’s character library includes both original characters created by HiveVia (protected by copyright) and characters based on traditional folklore (in the public domain). Original HiveVia characters may not be copied, reproduced, or used without our written permission.
6.3 Limited licence
We grant you a limited, non-exclusive, non-transferable licence to access and use our Site for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works from our content without our prior written consent.
6.4 Third-party content
Hotel images, logos, and descriptions displayed on our Site may be provided by our affiliate partners under licence. These remain the property of their respective owners.
7. Acceptable Use
You agree not to:
- Use our Site for any unlawful purpose.
- Attempt to gain unauthorised access to our systems or other users’ accounts.
- Interfere with or disrupt the operation of our Site.
- Scrape, crawl, or automatically collect data from our Site without our written permission.
- Use our Site to distribute spam, malware, or other harmful content.
- Impersonate any person or entity.
- Use our affiliate links in a way that violates our affiliate partners’ terms.
8. Disclaimers
8.1 “As is” basis
Our Site and services are provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the accuracy, reliability, or availability of our Site or its content.
8.2 Travel information
Cultural information, country guides, and travel advice on our Site are for general informational purposes only. We recommend checking official government travel advisories (smartraveller.gov.au for Australian travellers) before travelling.
8.3 Third-party services
We are not responsible for the content, policies, or practices of any third-party websites or services linked from our Site, including our affiliate partners.
9. Limitation of Liability
To the maximum extent permitted by law, HiveVia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Site or services. Our total liability to you for any claim arising from your use of our Site shall not exceed the amount you have paid to HiveVia (if any) in the 12 months preceding the claim.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
10. Indemnification
You agree to indemnify and hold harmless HiveVia, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of our Site, your violation of these Terms, or your violation of any third party’s rights.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on our Site. Your continued use of our Site after such changes constitutes your acceptance of the updated Terms.
